Terms of Service
1. Our Faith-Based Commitment & Right to Decline
HelpMate Designs is proudly a Christian, faith-driven agency. We seek to serve clients whose values align respectfully with our mission. We reserve the right to decline or discontinue service to any prospective or current client whose requests, projects, or business practices conflict with our faith convictions or ethical standards. Any refusal will be handled respectfully and without discrimination.
2. Intellectual Property
All website designs, graphics, content, source files, and intellectual property created by HelpMate Designs for the Client (“Projects”) shall be the Client’s sole property upon full payment. However, HelpMate retains ownership of all underlying tools, methodologies, and pre-existing intellectual property.
HelpMate Designs reserves the right to showcase the completed Projects for portfolio, marketing, and social media purposes unless explicitly agreed otherwise in writing.
3. Ownership & Client Representations
Client affirms that all materials provided for use in Projects (including text, logos, images) are owned by the Client or legally licensed for use, and do not infringe on third-party rights. Client agrees to indemnify HelpMate Designs against any claims arising from such materials.
4. Use of Third-Party Assets
If Projects require licensed third-party fonts, images, plugins, or other assets, HelpMate Designs will notify Client of any required licenses. Client is responsible for acquiring and maintaining those licenses for lawful use of the final Project.
5. Client Conduct & Responsibilities
Clients agree to:
Provide accurate, lawful content and instructions;
Communicate respectfully and cooperate with HelpMate during the project;
Avoid use of our services for unlawful, harmful, or unethical purposes;
Respect HelpMate’s Christian values and agency guidelines.
6. Feedback and Submissions
Any ideas, suggestions, or feedback provided by Client during or after the project are considered non-confidential and may be used by HelpMate Designs freely. Client waives any claims related to HelpMate’s use of such feedback.
7. Privacy and Data
HelpMate Designs respects your privacy and complies with applicable laws regarding your data. Client consents to the transfer and processing of information in the United States. For detailed information, see our Privacy Policy.
8. Payment, Refunds & Cancellation
Full payment or agreed deposits are required before project commencement. Refunds are not guaranteed and considered on a case-by-case basis, especially once significant work has been delivered.
If a refund is approved within the first 30 days, a cancellation fee of 25% of the contract value will apply, and the Client will not retain rights to work completed. Transaction fees are non-refundable.
9. Limitation of Liability
HelpMate Designs and its team are not liable for any indirect, incidental, or consequential damages arising from use of our services. We make no guarantees of specific results, only commitment to quality service delivered faithfully.
10. Indemnification
Client agrees to indemnify and hold harmless HelpMate Designs and its representatives from any claims, damages, or losses arising from Client’s breach of these terms or violation of laws.
11. Service Availability & Modifications
HelpMate Designs strives for reliable service but does not guarantee uninterrupted access. We may modify or discontinue services at our discretion without prior notice.
12. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the State of Texas. Disputes will be resolved in local courts of competent jurisdiction. We strive to resolve disagreements amicably and prayerfully.
13. Electronic Communications & Signatures
By engaging our services, Client consents to electronic communications and agreements, including digital signatures, which hold the same legal effect as written documents.
14. Final Note
